WHISTLEBLOWING
Companies and entrepreneurs are required to develop and implement appropriate internal regulations (whistleblowing systems) that enable whistleblowers to report legal violations under the new law.
A whistleblower may be any individual who reports or publicly discloses information about a legal violation obtained in a work-related context (including employees, contractors under civil law agreements, entrepreneurs, interns, trainees, attorneys-in-fact, shareholders, or partners).
A report may cover actions or omissions that are unlawful or intended to circumvent the law, relating to areas specified in the legislation, including corruption, anti-money laundering, environmental protection, food safety, public health, consumer protection, privacy and personal data protection, as well as network and information system security.
Entities subject to the law must implement the appropriate regulations by:
- establishing proper internal procedures in accordance with the requirements set forth in the legislation, and agreeing, communicating, and publishing them internally,
- designating and providing reporting channels,
- appointing and authorizing individuals to handle reports,
- maintaining a register of reports,
- ensuring protection for whistleblowers.
This obligation applies to legal entities (including companies and entrepreneurs) that meet the criteria defined by the law.
We provide our clients with:
- assistance in designing and implementing procedures in compliance with the law,
- comprehensive advice and support regarding the new obligations, including assistance in receiving and processing reports.
ACCESSIBILITY ACT
The Accessibility Act on ensuring compliance with accessibility requirements for certain products and services by business entities sets out the requirements, obligations, and oversight concerning the accessibility of products and services.
Compliance with the provisions is intended to enable individuals with disabilities and other functional limitations to freely access modern technologies, public transportation, information services, and the banking sector, thereby contributing to the creation of a more inclusive and equitable society.
The Act details the accessibility requirements for products and services, the conditions for ensuring these requirements are met, and the obligations imposed on business entities.
Among these obligations, the Act requires that information be provided through multiple sensory channels, in a manner that ensures its comprehensibility. This includes the use of fonts in appropriate sizes and styles, consideration of anticipated usage conditions, and the application of sufficient contrast and spacing between letters, lines, and paragraphs, as well as an alternative presentation of non-text content.
Electronic information must be delivered in a way that guarantees perceptibility, functionality, understandability, and compatibility – this also applies to the consistency of websites and mobile applications.
We offer comprehensive consultancy on accessibility regulations.
We provide legal support to entrepreneurs required to adapt their offerings to meet accessibility requirements, including compliance analysis, the development of necessary procedures, and assistance in communicating with clients in accordance with new standards of language and communication formats.
